Carlton Fisk Lawyer Wants Judge to Strike Out DUI Evidence

The lawyer for White Sox legend Carlton Fisk filed motions to have evidence thrown out in the Hall of Famer's drunken driving case.

 

The lawyer for White Sox immortal Carlton Fisk is fighting to get the Hall of Famer's driver's license back and to have evidence ejected from his drunken driving case.

Fisk, 64, lost his license when he allegedly refused to take a breathalyzer test during his arrest Oct. 22 on charges of driving under the influence, improper lane usage and illegal transportation of alcohol.

But the Sox star had actually volunteered to take the blood-alcohol test, according to a petition filed Thursday by his attorney, Stephen White.

White also filed a motion claiming the New Lenox police illegally arrested Fisk since there was "no reasonable suspicion of criminal activity" to give them cause to pull him over in the first place.

Only Fisk wasn't pulled over by the police. He was allegedly found passed out behind the wheel of his pickup truck in a cornfield. Officers who went to check on  Fisk reportedly found a bottle of vodka in the pickup.

Paramedics transported Fisk to Silver Cross Hospital for an examination. He was arrested after he was released from care.

Fisk, who is fourth on the White Sox's all-time home run list, did not appear for the Thursday hearing. He is scheduled to return to court Nov. 29.

What a bum. Not only does he pass out drunk at 7pm behind the wheel, but now he tries to lawyer his way out of it. The HOF should post a copy of the police report, his mugshot, and a newspaper article of the story next to his name so everyone can remember how much of a bum he is as opposed to a stand up guy who would admit his mistakes and take responsibility.

I hope he's not paying this lawyer a lot of money to defend him. He sounds like a moron. GIVE ME A BREAK!! Hahahaha! What a chump.

Yeah John he should not have hired a lawyer and just went to court and said "you got me-my bad" cause thats what happens in most court rooms....He may be a bum but trying to beat the rap is something everybody does.

A guy of his stature should have admitted himself into rehab, got help, then brought his lawyer to court to tell the judge his client cleaned up and ask for leniency in sentencing(which would probably be a couple thousand dollar fine). Instead he hires a high priced lawyer to get the case thrown out on a technicality, and since this lawyer is an ex-Will County judge, it wont surprise me the case gets dropped.

I didnt mean that he has do to anything. I dont care wtf he does, maybe next time he will pass out in a pond instead of a corn field. I just meant that it would have been the "right" or perhaps noble thing to do. You know, take responsibility for your actions.

I know what you are saying John but I am sure he would tell you it's a one time incident and he does not have a problem. Maybe when he was drinking he thought that cornfield was the one in "Field of Dreams"

Even White won't be able to help him on this one....the eyes of the entire community are on him and the presiding Judge.

Bye, bye....Carlton. Facts: cops saw your car in a corn field; car running; key in ignition; damaged front wheel made car inoperable; Fisk sleeping in driver seat; partially finished Vodka bottle in car; strong odor of alcohol on Fisk when police awakened Fisk; Fisk refused to blow breathalizer.

Routine lawyer motions won't get him anywhere.

He'll lose his driving priviliges for a year in December for his failure to blow. If he gets judicial driving permit for some reason, he will have to have a machine in his car ignition which checks his breath before he starts the car.

Tougher than hitting a cutter from Mariano Rivera.

Bye, bye, Carlton....Should cost you about $10,000 in total, including classes, fines and costs.
