Public Comment Leads to Heated Discussion at Village Board Meeting

A community member's comments regarding information requests quickly led to a tense conversation that included several board members.

 

A heated discussion between a local resident and several members of the Mokena Village Board of Trustees punctuated the Feb. 25 board meeting.

During the meeting’s public comments portion, community member Jim Giglio addressed several Freedom of Information Act requests that he had filed with the village.

As he presented his comments, Giglio and the members of the board repeatedly interjected and spoke over one another.

Among the issues Giglio addressed was a request for the line item expenditures for all costs to the village related to the municipal election petition challenge that occurred in mid-January.

The candidacy petitions filed by four current board members were challenged by a non-incumbent candidate group, the Mokena Friends and Neighbors Candidates. All petitions were determined to be legitimate by an appointed electoral board.

Giglio’s concern involved the approximately $12,000 he says the municipal government spent to compensate the village attorney for her involvement with the situation.

“That number seems outrageous to me,” said Giglio, in an interview with Patch.

Giglio expressed his desire to know why it was necessary for the village attorney to be involved with the petition challenge. Mokena Mayor Joe Werner said she was present at the petition challenge meeting in order to represent the electoral board members, not a particular candidate group.

“It’s certainly appropriate that they would have proper representation,” said Werner.

Giglio also filed a request for lists of all the registered businesses in the village between 2006-2013 and accused Trustee John Mazzorana of using the trustee’s comments portion of a recent board meeting as an opportunity for political self-promotion.

He told Patch that he filed the business list requests in order to accurately assess the “lack of business growth” in Mokena.

“They don’t want us in office,” said Mazzorana. “It’s that simple.”

In addition, Giglio requested to see the village directives, expenditures and correspondence related to the events surrounding the 2008 civil rights lawsuit filed by Tino Lettieri against the village.

In a board work session immediately following Monday’s meeting, Village Administrator John Downs gave a presentation on water distribution and sanitary collection systems in Mokena.

The village will spend approximately $500,000 on water main replacements in 2014 along 3rd Street and Midland Avenue.

Additionally, Downs proposed that $115,000 per year be spent on manhole repairs for the next five years. The village focused primarily on replacement and repair of sanitary sewers during the previous decade.

“The data does show that the work’s been effective,” said Downs.

What is the cost to the taxpayers to make these documents available? Will Mr Giglio and his cronies make a donation in kind to cover these costs? Is this kind of behavior what we have to look forward to in Mokena government for the next 4 years?

If the people of Mokena speak in favor of Mazzorana, Metanias, and Siwinski like I hope they will, no you will not have this kind of behavior for the next 4 years. Have you had this behavior for the last 4 years? NO. I do believe though that Giglio will pay the normal fees the village charges for copies of information he is requesting. This will not be done "pro bono" like their objections were done. Did the FANS organization seriously think that because they were represented by a Mokena law firm pro bono that nobody else had fees to pay? Well now the know. The incumbents and the village had large fees to pay. Now we all know why they proceeded with a very weak objection case. Because they were not paying any legal fees. And Giglio kept using himself as an example in years past in Thornton Township having his petitions objected to. I guess he forgot to tell everyone while he was on free tv that he was forced to resign as Thornton Township trustee when they found out he moved to Mokena and was still acting as a trustee there. Imagine that, you have to live in the area that you are elected to represent. And the next Mayor, Frank Fleischer, is surrounding himself with many people like Giglio. Get the vote out on April 9th Mokena!

Does the administration try to restrict the involvment of its residents by throwing the costs issue at them ? If village employees can be made available during working hours to help with Mayor Werners numerous private charity functions( non village related ) then they should certainly be available to do the work of the Village which includes FOIA requests. Why were we never made aware of the costs to the Taxpayer from the Civil Rights Violation of one of our residents ? If we're going to criticize one item then we should be forthcoming and transparent for all items .

The village employees have always don FOIA requests as long as the person requesting the information pays for the copies. The insurance company paid Tino before it went to a hearing just to get rid of the case. I wish it would have gone to trial. Tino would have lost big time and would have had a bunch of legal fees of his own to pay.

Amanda, as always you never let the facts ruins a good story. You are ABSOLUTEY WRONG about the Lettieri Civil Rights law suit. It did go to court, Tino asked for 15k. The arbitrator thought this violatin to be so aggregious that he awarded Tino 67%, 25k, more than requested. All Tino wanted was an apology. The village produced no witnesses or signed testimony at the civil rights hearing.

When Tino arrived at the opening of the polls at 6am a Mokena Police OFFICIAL was there waiting for him. It's all public record.

Now, how would you happen to know that village employees ALWAYS take care of FOIA requests if copies are paid for? Your so busy waving pom-pons for the good old boys you can't even spend a few minutes with the truth. Mr. Giglio did all of Mokena a huge favor by bringing these shenanigans to light.

Amanda , What were the legal fees and village costs associated with Mr Lettieri's Civil Rights Violation Suit ? Yes the insurance paid the settlement of $25,000 after a full hearing and arbitration board decision. What were the legal fee's and costs to the Village ? An APOLOGY was all that was asked for , a simple apology !

Mrs. bowl, I know Jim Giglio from his Thornton days. He was one heck of representative of the people in Thornton Township. He has come out publicaly to challenge the elected officials as is his right. He doesn't hide behind Internet postings. If you have proof that he did something wrong then bring it. One thing I know for sure. You won't show yourself in public and debate him. He's been a better representative of the people than the cast of characters we have up there now. He has never asked for anything for himself in front of our village board. Like one other commenter said, you never let the facts get in the way of a good story. Thank you Jim for always being a stand up person.

Amanda , What are you talking about ? Again you haven't got your facts even close to right . Please answer the question of what costs and legal fees were incurred because Werner , Mazzorana , Downs and company were found to have Violated a Mokena residents Civil Rights ? What did it cost the Taxpayers because of our administrations abuse of one of our residents ? You seem to know everything else .

Does anyone else find it funny that whenever Amanda Bowl or someone else tied to the Current board is asked a factual question and where the answer may not be positive for their friends they refuse to answer it and again begin with personal attacks ? I agree with Thornton Ranger that at least Mr Giglio stands up in front of the Board on cable asks his questions and expresses his views even if some may disagree with him.

When will my fellow Mokena residents take the blinders off and take a good, hard look at the current mayor and his 3 loyal trustees? Look at Front St.; look at Wolf Rd; look at the former Ace Hardware strip mall on LaPorte Rd with only a dry cleaners remaining! Not only have the incumbents not brought any meaningful businesses to Mokena, they've allowed existing businesses to leave...and without replacement!
How is it that while our community lags behind all of our neighbors in economic development, our incumbents have managed to purchase the decent foreclosures in town prior to announcing those properties to the public? I smell a rat...or three.
Kudos to Giglio for trying to enlighten those dear citizens that think that the incumbents care about our community! They are only in office to help themselves. Take the blinders off, people, and vote them out of office for good.
Oh, and one more thing, why is it that our Lake Michigan water smells an awful lot like our old well water?

The costs incurred by the village are a direct result of the frivolous challenges brought to the electoral board by these so called "friends and neighbors" of Mokena. And now they want to put the onus for this debt on the incumbants? Outrageous!

No Norm, the challenge was initiated because of the "Clerks Mistake " allowing Election Law to be violated and then the signature challenge was then included because those petitions were done so sloppily. REALLY

Really? They filed the petition challenge because they had pro bono legal representation. If they had to pay legal fees themselves, they never would have challenged. Remember that Mokena law firm incumbent supporters when you need to use a lawyer for something.

Can someone explain just why these incumbents deserve to be reelected? What positive actions have they accomplished? Between all of them not one new or (outside the box) idea has been put on the table. Like all local communities they seem to be guided by the Illinois Municipal League, supposedly a NGO which in turn seems to be guided by national guidelines that upon close examination are sinister in nature. All these local governments are the same. They all want more and more money to constantly expand and the only thought they have to acquire this revenue is known as Economic Development. They never seem to talk about police and fire pensions and how to pay the future cost which are rising every year. The typical Mokena yuppie wants more and bigger everything. Big houses and cars, more and bigger stores, wider roads, more restaurants, more police payroll, and on and on it goes. How about trying something new, downsize all of it. Less growth, or zero growth means less congestion (in the past this condition was desirable, not so much now apparently). In the past isn’t that why most came here? The tight consolidation of our communities that can be more easily controlled is the goal. Why do so many fail to see where this is going? One giant prison. “A perfect slave THINKS he is free”.

Good point! Every time a national retailer has come to Mokena, the surrounding residents come out and oppose. It will reduce property values, bring crime, etc. The incumbants have actively tried to assist businesses that have problems with their landlords to keep them in their location. I remember when Frank was on the Board he did not want Home Depot and threw a fit at the color of a building. When he was in office it was a nightmare. We need to keep the current leadership and say goodbye to the crew trying to replace them. If the FANS candidates get in, the Village Hall staff will be completely different and I for one enjoy the people there.

Y'all are missing the point. The ruling on the challenge against Mr. Metanias went 2-1. Atty. McGrath served as the panel chair thereby ruling on objections and presiding over the proceeding with the panel's other two lawyers, Atty. Carey - who voted contra Metanias and Atty. Gryczewski who voted pro. As an attorney who was asked by the challenged trustees to serve in their stead, he had an ethical obligation to disclose his conflict to both parties prior to the proceedings. Indeed, he was hired by Village in 2009 as an hourly attorney for ordinance violations; he is an adjudication officer, and serves on the police pension board for Mokena. None of this elaborate and tangled history was disclosed. The challengers should have been afforded the opportunity to move that he recuse himself based on these existing conflicts. Had he failed to do so after being asked, would likely have been considered reversible error by a circuit court reviewing the proceedings. Until Mr. Fleischer is sworn is as mayor, Mr. McGrath serves at the whim of Mayor Joe whose petitions were simultaneously being challenged. McGrath failed reveal his conflicts, conferred with the other lawyers during break, and ruled against the challengers. The ruling is thus tainted. Accordingly all Mokena residents who eventually vote for Metanias in April would be drawing fruit from a tainted and poisonous tree as, either his petitions, or candidacy should have been stricken or withdrawn sua sponte.

Been watching a lot of late night lawyer show reruns, haven't you Alex? Too bad your argument sounds more Mayberry than Perry.

The electoral board were appointed to their positions by the Chief Judge of Will County, not by the incumbent trustees. Mr. McGrath had the confidence and trust of the Chief Judge of Will County to adjudicate these proceedings, which he did so honorably. Mr. McGrath served the law, and for you to suggest otherwise is ridiculous.

The challengers had legal representation. Their attorneys could have brought up all this same information about McGrath that you have. Either they didn't because they were working for free or they knew they had the same situation with retired Judge Penn working for their firm and also a Mokena employee.

Norm , McGrath was ethically bound to disclose his conflict but didn't , as an officer of the court he violated those ethics. What's even worse is he did not follow the law he strayed from it to protect his BOSS JOE WERNER who shortly after the proceedings quit the race. I'd bet McGrath egrets his ethical violation now ? He did not serve honorably and had a chance to disclose his conflict when another member of the board did so explaining a casual relationship with the objector but McGrath hid the truth.

Pay attention! The objectors couldn't even file an appeal because their attorney withdrew the objections on Siwinski and Mazzorana. Call the objectors attorney and ask him why he did that. I am sure he will answer your question pro bono.

Amanda you are still avoiding answering the questions about the legal fees from the Civil Rights Violation. We don't care if there is an appeal with the petitions, McGraths refusal to disclose his conflict tainted the whole process. Now instead of trying to change the subject answer the civil rights legal fee question please ? I know you won't and will attack someone else personally but that's ok too because you offer to the residents a window into the attitudes and demeanor of the incumbents . It's obvious your blinded by anger and cannot process rationally on an adult level. Again , how much did Werner ,Mazz and Downs cost the Taxpayer when they were sued for Violating Mr Lettieri's Civil Rights ? When u don't answer the residents will know by your avoidance that its a lot of money !

And I don't care how much the Tino case cost the Village. Tino being Tino tainted that whole process. They felt sorry for him. And Giglio will be announcing at the next board meeting how much the village paid. He needs to finish what he started. He needs to do it on TV because now all of Mokena is waiting and the incumbents don't care if he makes an idiot of himself again at a meeting. And the majority of the residents know that the FANS are not good for Mokena.

It's interesting that when a resident ie: Giglio speaks out about an issue he believes is wrong he somehow becomes a villain but I've seen the village board including Werner, Mazzorana , Siwinski , Labriola and Metainias "Publicly Thank Him " at miltiple village board meetings for his support in their elections ? Why didn't you or them have issue with it then ?

I don't think the village board thought him a villain that night. I am the one that thinks he is a villain and would never thank him for anything. Mazzorana was stating his case on the petition objection, but Giglio wanted his way and only his way. Whatever.If he ever supported anybody but Labriiola, he did so trying to get something for himself. When that didn't happen, he's mad. Whatever.

They have used the same Official photos on Village Website and Campaign Signs and Brochures and now they are using the village email !
